Order V, Rule 1.
Summons:
(1) When a suit has been duly instituted a summons shall be issued by the officer of the Court appointed in this behalf to the defendant within five working days from the date of filing the suit to appear and answer the claim on a day to be therein specified.
Provided that if the officer of the Court fails to issue the summons within the said period of time, he shall be liable for misconduct.
Provided further that no such summons shall be issued when the defendant has appeared at the presentation of the plaint and admitted the plaintiff’s claim.
(2) A defendant to whom a summons has been issued under sub-rule (1) may appear-
(a) in person, or
(b) by a pleader duly instructed and able to answer all material questions relating to the suit, or
(c) by a pleader accompanied by some person able to answer all such questions.
(3) Every such summons shall be signed by the Judge or such officer as he appoints, and shall be sealed with the seal of the Court.

আদেশ ৫, নিয়ম ১।
সমনঃ
(১) যথাযথ উপায়ে মোকদ্দমা দাখিল করার পর নির্ধারিত তারিখে বিবাদীকে উপস্থিত হতে এবং বাদীর উত্তর প্রদান করতে সমন দিতে হবে।
তবে শর্ত থাকে যে, যদি বিবাদী আরজী পেশ করার সময়েই হাজির হয়ে বাদীর দাবী স্বীকার করে নেয়, তবে এরূপ কোন সমন প্রেরণ করা যাবে না।
(২) বিবাদীর উপর উপ-বিধি ১ মোতাবেক সমন প্রেরণ করা হলে নিম্নোক্ত যে কোন পদ্ধতিতে বিবাদী হাজিরা দিতে পারবে-
(এ) ব্যক্তিগতভাবে, বা
(বি) মক্কেলের নির্দেশপ্রাপ্ত এবং মোকদ্দমা সংক্রান্ত গুরুত্বপূর্ণ সকল প্রশ্নের উত্তর প্রদানে সক্ষম এবং কোন কৌশুলী কর্তৃক, বা
(সি) অনুরূপ সকল প্রশ্নের উত্তর প্রদানে সক্ষম কোন ব্যক্তি সহযোগে কোন কৌশুলী কর্তৃক বিবাদী হাজিরা দিতে পারে।
(৩) উপরোক্ত প্রত্যেকটি সমনে বিচারক কিংবা তৎকর্তৃক নিযুক্ত কর্মকর্তার স্বাক্ষর থাকবে এবং উক্ত আদালতের সীলমোহরে মোহরাঙ্কিত থাকতে হবে।
