Order V, Rule 5.
Summons to be either to settle issues or for final disposal:
The Court shall determine, at the time of issuing the summons, whether it shall be for the settlement of issues only, or for the final disposal of the suit; and the summons shall contain a direction accordingly.
Provided that, in every suit heard by a Court of Small Causes, the summons shall be for the final disposal of the suit.

আদেশ ৫, নিয়ম ৫।
বিচার্য বিষয় স্থিরকরণ কিংবা চূড়ান্ত নিষ্পত্তির জন্য সমনঃ
আদালত সমন প্রদানকালীন সময়েই স্থির করবেন যে, শুধুমাত্র বিচার্য বিষয় নির্ধারণকরণ কিংবা মোকদ্দমার চূড়ান্ত সমাধানের জন্য দেওয়া হচ্ছে এবং সেই মোতাবেক সমনে প্রয়োজনীয় নির্দেশ প্রদান করা হবে।
অবশ্য শর্ত থাকে যে, ক্ষুদ্র বিষয়ক বিচারাদালত কর্তৃক শ্রুত প্রত্যেকটি মোকদ্দমার চূড়ান্ত সমাধানের জন্য সমন প্রদান করা হবে।
