The Code of Civil Procedure, 1908 । Order 4, Rule 1. Suit to be commenced by plaint

Order IV, Rule 1.
Suit to be commenced by plaint:
(1) Every suit shall be instituted by presenting a plaint to the Court or such officer as it appoints in this behalf a plaint together with as many true copies of the plaint as there are defendants for service of summons upon such defendants.
(1a) The Court fees chargeable for service of summons shall be paid in the case of suits when the plaint is filed, and in the case of all other proceedings when process is applied for.
(1b) A plaintiff shall file, along with the plaint, for each defendant a copy of the summons along with a pre-paid registered acknowledgement due cover with complete and correct address of the defendant written on it.
(2) Every plaint shall comply with the rules contained in Orders VI and VII, so far as they are applicable.

আদেশ ৪, নিয়ম ১।
মোকদ্দমা আরজি দাখিলের মাধ্যমে দায়ের করতে হবেঃ
(১) আদালত কিংবা তৎকর্তৃক এতদুদ্দেশ্যে নিযুক্ত কর্মকর্তার নিকট, আরজি উপস্থাপন করার মাধ্যমে প্রত্যেকটি মোকদ্দমা দাখিল করতে হবে এবং আরজি সংশ্লিষ্ট যতজন বিবাদী থাকে, ততগুলো আরজির অবিকল নকল অনুরূপ সকল বিবাদীর উপর পরোয়ানা জারি করার জন্য পেশ করতে হবে।
(১এ) মোকদ্দমার বেলায় পরোয়ানা জারি করার জন্য নির্ধারিত প্রদেয় কোর্ট ফি আরজি দাখিল করার সময় এবং অন্যান্য কার্যক্রমের ক্ষেত্রে যখন পরোয়ানা ব্যবহার করা হয়। তখন পরিশোধ করতে হবে।
(১বি) সমনের একটি নকলসহ প্রত্যেক বিবাদীর জন্য সকল বিবাদীর পূর্ণ ও সঠিক ঠিকানা যুক্ত যথোচিত খামে আগাম প্রদত্ত প্রাপ্তি স্বীকারপত্র আরজির সঙ্গে বাদীকে পেশ করতে হবে।
(২) ৬ষ্ঠ ও ৭ম আদেশের বিধিসমূহ যতদূর প্রযোজ্য হয়, তদনুসারে প্রত্যেকটি আরজি প্রণয়ন করতে হবে।
