Order V, Rule 25.
Service where defendant resides out of Bangladesh and has no agent:
(1) Where the defendant resides out of Bangladesh and has no agent in Bangladesh empowered to accept service, the summons shall be addressed to the defendant at the place where he is residing and sent to him by post or through courier service as mentioned in sub-rule (4) of rule 9, if there is postal communication between such place and the place where the Court is situate.
(2) The Court may, in addition to the service of summons under sub-rule (1), on the application of the plaintiff for the issue of a summons for the appearance of the defendant, also direct the summons to be served by means of transmission of documents through fax massage or electronic mail service by the plaintiff at his own cost.

আদেশ ৫, নিয়ম ২৫।
যেক্ষেত্রে বিবাদী বাংলাদেশের বাহিরে বসবাস করে এবং তার কোন প্রতিনিধি না থাকে, সেক্ষেত্রে সমন জারিঃ
(১) যেক্ষেত্রে বিবাদী বাংলাদেশের বাহিরে বসবাস করে এবং সমন গ্রহণের নিমিত্ত ক্ষমতাপ্রাপ্ত কোন প্রতিনিধি বাংলাদেশে না থাকে, তাহলে আদালত যেখানে অবস্থিত, সেখানকার সাথে বিবাদীর বাসস্থানের ডাকযোগাযোগ থাকলে বা বিধি ৯ এর উপ-বিধি (৪)-এ বর্ণিত কুরিয়ার সার্ভিস এর মাধ্যমে বিবাদীর নামে সমন তার ঠিকানায় প্রেরণ করতে হবে।
(২) আদালত উপ-বিধি (১) এ বর্ণিত সমন প্রেরণের বিধানের অতিরিক্ত হিসাবে বাদীর আবেদনের প্রেক্ষিতে বিবাদীকে হাজির হওয়ার জন্য সমন জারি করতে পারে এবং একই সঙ্গে ফ্যাক্স বার্তার মাধ্যমে অথবা ইলেকট্রনিক মেইল সার্ভিসের মাধ্যমে বাদীকে নিজ খরচে সমন প্রেরণের নির্দেশ দিবেন।
