Section 34. Interest:
(1) Where and in so far as a decree is for the payment of money, the Court may, in the decree, order interest at such rate as the Court deems reasonable to be paid on the principal sum adjudged, from the date of the suit to the date of the decree, in addition to any interest adjudged on such principal sum for any period prior to the institution of the suit, with further interest at such rate as the Court deems reasonable on the aggregate sum so adjudged, from the date of the decree to the date of payment, or to such earlier date as the Court thinks fit.
(2) Where such a decree is silent with respect to the payment of further interest on such aggregate sum as aforesaid from the date of the decree to the date of payment or other earlier date, the Court shall be deemed to have refused such interest, and a separate suit therefore shall not lie.
ধারা ৩৪। সুদঃ
(১) যেখানে ও যতদূর সম্ভব ডিক্রিটি টাকা পরিশোধ সম্পর্কিত হলে, সেখানে আদালত তার ডিক্রিতে মোকদ্দমা দায়েরের পূর্বে কোন সময়ের জন্য আসল টাকার উপর বিচারপ্রাপ্ত কোন সুদের অতিরিক্ত, বিচারপ্রাপ্ত আসল টাকার উপর মোকদ্দমার তারিখ হতে ডিক্রির তারিখ পর্যন্ত প্রদেয় আদালত যুক্তিসঙ্গত বিবেচনা করে এরূপ হারে সুদ, এবং ডিক্রির তারিখ হতে টাকা পরিশোধের তারিখ পর্যন্ত কিংবা আদালত সঠিক মনে করে এরূপ আরো পূর্বের তারিখ হতে টাকা পরিশোধের সমগ্র টাকার উপর আদালত যুক্তিসঙ্গত বিচার বিশ্লেষণ করে এরূপ হারে আরো অধিক সুদ দেওয়ার জন্য আদেশ দিতে পারে।
(২) যেখানে ডিক্রির তারিখ হতে টাকা পরিশোধের তারিখ পর্যন্ত কিংবা আরো পূর্বের তারিখ হতে উপরিউক্ত সমস্ত টাকার উপর অধিক সুদ পরিশোধ সম্পর্কিত ডিক্রি নীরব থাকে সেখানে আদালত উক্ত সুদ অগ্রাহ্য করেছে বলে বিবেচিত হবে ও এইজন্য পৃথক মোকদ্দমা চলবে না।
